1. Acceptance of terms
By creating an account or using SENDA ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. This is a starter Terms of Service prepared for SENDA's private beta — it is not a claim of review by formal legal counsel, and it will be revised as the product and business mature.
2. Eligibility and account responsibility
You must be able to form a binding contract to use SENDA, and you must provide accurate account information. You are responsible for all activity under your account and for keeping your login credentials secure.
3. Description of SENDA
SENDA is an AI Sales Manager that learns about your business, helps identify prospects, assists with outreach, and helps interpret replies to recommend next actions. SENDA is a tool that assists your sales process — it does not guarantee outcomes.
4. Private beta / evolving product
The Service is currently in private beta. Features, availability, and behavior may change, be added, or be removed at any time without notice. Beta access may require an access code and may be limited, paused, or revoked at SENDA's discretion.
5. Acceptable use
You agree not to use SENDA for spam, harassment, fraud, impersonation, or any illegal activity, and not to use the Service to violate the rights of others or to attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
6. Your responsibility for outreach
You are solely responsible for the content, targeting, and legality of any outreach you send or approve through SENDA, including compliance with applicable email, marketing, anti-spam, and privacy laws (such as CAN-SPAM, CASL, and equivalent laws in your jurisdiction). SENDA assists with drafting and recommendations; you decide what is actually sent.
7. Third-party services and integrations
SENDA integrates with third-party services (for example Google/Gmail, and data or infrastructure providers described in our Privacy Policy) to operate. Your use of those integrations is also subject to the applicable third party's terms.
8. Google / Gmail integration
If you connect a Gmail account, SENDA uses that connection only to send outreach you have approved and to synchronize replies for conversations SENDA manages on your behalf. You may disconnect this integration at any time from within the app.
9. AI-generated recommendations and content
SENDA uses AI models to generate suggested messages, scoring, and recommendations. This output may be inaccurate, incomplete, or unsuitable for a given situation. You are responsible for reviewing any AI-generated content before it is sent or acted upon.
10. No guarantee of results
SENDA does not guarantee any specific number of leads, replies, meetings, sales, or revenue. Outcomes depend on many factors outside SENDA's control, including your market, offer, and how outreach is used.
11. Data and account security
You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.
12. Intellectual property
SENDA and its underlying software, design, and branding are owned by SENDA or its licensors. These Terms do not grant you any rights to SENDA's intellectual property except the limited right to use the Service as intended.
13. Your content
You retain ownership of the business information, leads, campaign data, and other content you provide to SENDA ("Your Content"). You grant SENDA a limited license to use Your Content solely to operate and provide the Service to you.
14. Service availability
The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation, particularly during the private beta.
15. Suspension and termination
We may suspend or terminate your access to the Service, including for suspected violation of these Terms, misuse, or risk to the Service or other users. You may stop using the Service at any time.
16. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
17. Limitation of liability
To the maximum extent permitted by law, SENDA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.
18. Indemnification
You agree to indemnify and hold SENDA harmless from claims arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law, including claims arising from outreach you approved.
19. Changes to the Service or these Terms
We may update these Terms or the Service from time to time. Material changes will be reflected by updating the "Last updated" date below. Continued use of the Service after changes take effect constitutes acceptance.
20. Governing law
These Terms are governed by the laws of [jurisdiction not yet configured], without regard to conflict-of-law principles. This value is a placeholder until SENDA's operating jurisdiction is confirmed.
